Viele haben f\u00fcr den Fall vorgesorgt und z.B. auch eine Patientenverf\u00fcgung in Deutschland errichtet. Bei bevorstehenden Auslandsaufenthalten und Reisen nach Italien stellt sich dann allerdings die Frage, ob und in welchem Umfang die hierin getroffenen Anordnungen eigentlich auch beim Aufenthalt in Italien Bindungswirkung f\u00fcr die dortigen \u00c4rzte und Einrichtungen entfalten oder ob f\u00fcr einen solchen Aufenthalt nicht neue, eigenst\u00e4ndige Verf\u00fcgungen ben\u00f6tigt werden.<\/em><\/strong><\/h2>\n\n\n\n<p>Dies insbesondere vor dem Hintergrund, dass nunmehr auch in Italien ein Gesetz \u00fcber Patientenverf\u00fcgungen in Kraft getreten ist (Gesetz Nr.&nbsp;219\/2017,&nbsp;sog. Richtlinie \u00fcber die Gesundheitsvorsorge, DAT=&nbsp;<em>disposizioni anticipate di trattamento<\/em>). Das italienische Gesetz regelt nun konkret die M\u00f6glichkeiten, in einer Verf\u00fcgung \u2013 dem sog.\u201c<em>testamento biologico<\/em>\u201d oder \u201c<em>biotestamento<\/em>\u201d- Angaben zu gew\u00fcnschten Behandlungen zu machen und kn\u00fcpft die Wirksamkeit von Patientenverf\u00fcgungen an bestimmte Voraussetzungen.<\/p>\n\n\n\n<p>Bei der Suche nach Antwort kommt man an den europarechtlichen Regelungen nicht vorbei. Betrachtet man die insoweit grunds\u00e4tzlich einschl\u00e4gige EU- Verordnung, das Haager \u00dcbereinkommen zum internationalen Schutz Erwachsener (HEs\u00dc), deren grunds\u00e4tzliches Ziel die Vereinfachung und Vereinheitlichung ist und die sowohl in Deutschland als auch in Italien gilt, so ist die Antwort auf die Frage, ob und unter welchen Voraussetzungen eine deutsche Patientenverf\u00fcgung in Italien Bindungswirkung entfaltet, aber nur auf den allerersten Blick eindeutig. Das HEs\u00dc hat das internationale Privatrecht f\u00fcr Vorsorgevollmachten neu geregelt und stellt bei Patientenverf\u00fcgungen entweder auf die Staatsangeh\u00f6rigkeit oder den gew\u00f6hnlichen Aufenthalt des Verfassers ab. So beruhigend das zun\u00e4chst erscheinen mag: wenn es um die Umsetzung der Anordnungen, die in der Patientenverf\u00fcgung getroffen sind, geht, so gilt das Recht des Staates, in dem der Betroffene medizinisch behandelt wird und wie die \u00c4rzte dort bereit sind, sich nach den Anweisungen in der Verf\u00fcgung zu richten.<\/p>\n\n\n\n<p>Von daher sollte man sich nicht ohne weitere rechtliche Pr\u00fcfung darauf verlassen, dass eine bereits in Deutschland errichtete Vorsorgevollmacht automatisch auch in Italien umgesetzt wird.
