Die italienische Mentalit\u00e4t, unterschiedliche Gesch\u00e4ftsauffassungen und die Wirtschaftskrise sind die Gr\u00fcnde daf\u00fcr, dass italienische Schuldner eher zu den schlechteren Bezahlern geh\u00f6ren. Die Folge: h\u00e4ufige Zahlungsausf\u00e4lle und die Notwendigkeit eines Inkassos in Italien. Was ist f\u00fcr ein Inkasso zu beachten? <\/strong><\/h2>\n\n\n\n

Inkasso nutzt dem Gl\u00e4ubiger wenig, wenn die Chancen auf Realisierung der Forderung beim Schuldner in Italien schlecht sind. Damit die grenz\u00fcberschreitende Forderungseintreibung nicht unwirtschaftlich wird, sollte zuvor eine Analyse der finanziellen Situation des Schuldners erfolgen. Auch in laufenden Gesch\u00e4ftsverbindungen empfiehlt es sich im \u00dcbrigen, rein vorsorglich in regelm\u00e4\u00dfigen Abst\u00e4nden die Solvenz des italienischen Gesch\u00e4ftspartners zu \u00fcberpr\u00fcfen. Dazu k\u00f6nnen in Italien entsprechende Ausk\u00fcnfte eingeholt werden, z.B. durch Anfragen bei \u00f6ffentlichen Registern f\u00fcr Immobilien oder beim Handelsregister. Da f\u00fcr die Einsichtnahme weitere Nachweise nicht erforderlich sind, ist der Informationszugriff leichter m\u00f6glich als in Deutschland, wo z.B. f\u00fcr eine Auskunft aus dem Grundbuch zun\u00e4chst ein \u201ebesonderes Interesse\u201c nachgewiesen werden muss. Mit den Ausk\u00fcnften kann dann zuverl\u00e4ssig entscheiden werden, ob ein Inkasso in Italien aussichtsreich erscheint.<\/p>\n\n\n\n

Bejahendenfalls richtet sich das weitere Vorgehen gegen den Schuldner danach, ob bereits ein vollstreckungsf\u00e4higer Titel gegen ihn vorliegt oder nicht. Im letzteren Fall ist zu \u00fcberlegen, ob zun\u00e4chst eine au\u00dfergerichtliche Zahlungsaufforderung erfolgen soll oder ob es ratsam ist \u2013 z.B. aus Gr\u00fcnden einer drohenden Verj\u00e4hrung der Forderung \u2013 sofort gerichtliche Schritte gegen den Schuldner einzuleiten.<\/p>\n\n\n\n

Im Fall, dass bislang kein vollstreckungsf\u00e4higer Titel vorliegt und au\u00dfergerichtliche Zahlungsaufforderungen erfolglos geblieben sind, besteht die M\u00f6glichkeit, sich \u00fcber das Europ\u00e4ische Mahnverfahren einen vollstreckungsf\u00e4higen Titel gegen den Schuldner zu beschaffen.<\/p>\n\n\n\n

Existiert bereits ein Titel, z.B. ein deutsches Urteil, durch das der Schuldner zur Zahlung verurteilt wurde, kann dieser Titel in einen Europ\u00e4ischen Vollstreckungstitel umgewandelt werden, aus dem dann in Italien die Zwangsvollstreckung betrieben werden kann.<\/p>\n\n\n\n

Zeit und Kosten kann sparen, wer in Deutschland einen europ\u00e4ischen Vollstreckungsbescheid f\u00fcr unbestrittene Forderungen erwirkt. Dieser europ\u00e4ische Vollstreckungstitel wurde durch die EU-Verordnung Nr. 805\/2004 eingef\u00fchrt und er wird in Italien automatisch anerkennt und vollstreckt, ohne dass es eines weiteren Zwischenverfahrens bedarf.<\/p>\n\n\n\n
