Eine Ausschlagungserkl\u00e4rung, die in fremder Sprache ohne \u00dcbersetzung in die deutsche Sprache beim Nachlassgericht eingereicht wird, ist nicht geeignet, die Ausschlagungsfrist zu wahren. Das hat das Oberlandesgericht K\u00f6ln entschieden (Beschluss vom 12.02.2014-2 Wx 25\/14).<\/strong><\/h2>\n\n\n\n

In dem vom Oberlandesgericht entschiedenen Fall wollte eine sich im Ausland aufhaltende Erbin die ihr in Deutschland zufallende Erbschaft ausschlagen. Zu diesem Zweck reichte sie beim deutschen Nachlassgericht eine durch einen ausl\u00e4ndischen Notar errichtete Urkunde ohne \u00dcbersetzung in die deutsche Sprache ein.<\/p>\n\n\n\n

Nach Auffassung des Gerichts ist hierdurch keine wirksame Ausschlagung erfolgt. Die Erbin hat die Ausschlagungsfrist vers\u00e4umt: zwar erlaube das ausl\u00e4ndische Recht im Heimatland der Erbin die Ausschlagung vor einem Notar. Dies gen\u00fcge allerdings nicht f\u00fcr eine wirksame Ausschlagungserkl\u00e4rung vor einem deutschen Gericht, da die Gerichtssprache die deutsche Sprache ist. Dem Umstand, dass Sprachprobleme und die damit notwendigen \u00dcbersetzungen eine gewisse Zeit erfordern k\u00f6nnen, tr\u00e4gt das Gesetz nach Ansicht des Oberlandesgerichts ausreichend dadurch Rechnung, dass f\u00fcr einen sich im Ausland aufhaltenden Erben die l\u00e4ngere Ausschlagungsfrist von sechs Monaten \u2013 anstatt der sechsw\u00f6chigen Regelfrist \u2013 gilt.<\/p>\n\n\n\n

Fazit: Eine fremdsprachige Ausschlagungserkl\u00e4rung f\u00fchrt nicht zur wirksamen Ausschlagung der Erbschaft vor einem deutschen Nachlassgericht. Bei auslandsbezogenen Erbf\u00e4llen muss daher darauf geachtet werden, dass \u00dcbersetzungen in die deutsche Sprache innerhalb der geltenden Fristen vorgelegt werden.<\/p>\n\n\n\n
