Gleichg\u00fcltig, ob Unterhalt gegen den nach Italien verzogenen Ehemann und Vater oder einfach eine sonstige titulierte Forderung im Ausland vollstreckt werden sollen, der b\u00fcrokratische Aufwand ist i.d.R. beachtlich und leider nicht selten auch vergeblich. Das soll sich jetzt \u00e4ndern.<\/strong><\/h2>\n\n\n\n<p>Mit Umsetzung der neuen Br\u00fcssel Ia-Verordnung, EU Nummer&nbsp;1115\/2012,&nbsp;soll die Anerkennung und Vollstreckung von Entscheidungen in Zivil- und Handelssachen erheblich erleichtert werden. Die Verordnung gilt ab 10.1.2015 in allen Mitgliedstaaten der Europ\u00e4ischen Union; mittelbar findet sie auch im Verh\u00e4ltnis zu D\u00e4nemark Anwendung.<\/p>\n\n\n\n<p>Wesentlicher Unterschied zur bisherigen Rechtslage ist der Wegfall des oft umst\u00e4ndlichen Vollstreckbarerkl\u00e4rungsverfahrens. Derzeit m\u00fcssen Gl\u00e4ubiger zivilrechtliche Titel zu Zwecken der Zwangsvollstreckung noch in einem gesondert durchzuf\u00fchrenden Verfahren in dem Staat, in dem vollstreckt werden soll, f\u00fcr vollstreckbar erkl\u00e4ren lassen; ein Verfahren, das oft Monate in Anspruch nimmt.<\/p>\n\n\n\n<p>Bei dem neuen Verfahren werden die Vollstreckungsmodalit\u00e4ten deutlich weniger umst\u00e4ndlich als bisher gefasst. K\u00fcnftig entf\u00e4llt das Erfordernis der \u00dcbersetzung des gesamten Vollstreckungstitels einschlie\u00dflich dessen Begr\u00fcndung. Ausreichend wird im Regelfall die Vorlage einer im Ursprungsstaat ausgestellten Vollstreckungsbescheinigung sowie gegebenenfalls eine \u00dcbersetzung dieser Bescheinigung sein. Der Titel selbst und dessen Entstehung werden nicht mehr gepr\u00fcft. Die Bescheinigung enth\u00e4lt s\u00e4mtliche, f\u00fcr die Vollstreckung relevanten Angaben.
