Zumeist wird er ausschliesslich mit Grosskonzernen, wie z.B. den spektakul\u00e4ren F\u00e4llen bei Siemens, MAN und Daimler, in Verbindung gebracht. Gerade sie haben besonders eindrucksvoll gezeigt, welch gravierende Folgen das Fehlen von Compliance Strukturen haben kann. Compliance Strukturen k\u00f6nnen erheblich zur Vermeidung von Schadensf\u00e4llen sowie zur Verbesserung des Unternehmensimages beitragen. Daher haben die Grosskonzerne inzwischen Compliance-Abteilungen aufgebaut. Anders bei den mittelst\u00e4ndischen Unternehmen, die in der Mehrzahl darauf verzichten. Zu Unrecht: auch Mittelst\u00e4ndlern drohen bei Kartellverst\u00f6\u00dfen und Korruptionsf\u00e4llen empfindliche Strafen. Zudem bringen Rechtsverst\u00f6\u00dfe die Unternehmen in die \u00f6ffentliche Kritik und verwickeln sie sowie ihre obersten F\u00fchrungsebenen in Haftungsf\u00e4lle<\/strong>.<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Obwohl auch f\u00fcr mittelst\u00e4ndische Unternehmen im Einkauf und im Vertrieb erhebliche Compliance-Risiken bestehen, verzichten sie in der Regel (noch) auf einen Compliance-Verantwortlichen. An der Compliance f\u00fchrt aber zwischenzeitlich kein Weg mehr vorbei. Dazu haben auch Regelwerke wie der&nbsp;<a href=\"http:\/\/www.kpmg.de\/Themen\/1439.htm\"><strong>Sarbanes-Oxley Act<\/strong><\/a>,&nbsp;<a href=\"http:\/\/www.kpmg.de\/WasWirTun\/5174.htm\"><strong>IFRS<\/strong><\/a>,&nbsp;<a href=\"http:\/\/www.kpmg.de\/Themen\/1437.htm\"><strong>Basel III<\/strong><\/a>&nbsp;oder&nbsp;<a href=\"http:\/\/www.kpmg.de\/Themen\/1438.htm\"><strong>Solvency II<\/strong><\/a>&nbsp;<strong>beigetragen.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Der Begriff<\/strong>&nbsp;Compliance umfasst die Einhaltung und \u00dcberwachung von Gesetzen, Richtlinien, internen Standards und freiwilligen Kodizes innerhalb eines Unternehmens. Am h\u00e4ufigsten kommt Compliance im Bereich der&nbsp;<a href=\"http:\/\/www.kpmg.de\/Themen\/9535.htm\"><strong>Wirtschaftskriminalit\u00e4t<\/strong><\/a>&nbsp;zum Tragen. Doch auch Bereiche wie Produkthaftung, Kapitalmarktrecht, Datenschutz, Umwelt- und Au\u00dfenwirtschaftsgesetze sowie Wettbewerbsrecht sind Compliance-Themen. Angesichts der Vielzahl der zu beachtenden Punkte und der Komplexit\u00e4t des Themas \u00fcberrascht es nicht, dass es h\u00e4ufig in mittelst\u00e4ndischen Unternehmen als (zu) grosse Herausforderung angesehen wird, ein effektives und effizientes Compliance Management zu betreiben.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Jetzt aber gibt es eine wertvolle Orientierungshilfe: eine Anleitung zum Aufbau eines Compliance-Management-Systems kommt aus \u00d6sterreich. \u00d6sterreich hat alserstesLandin Europa in diesem Jahr einen Standard geschaffen, nach dem Unternehmen ihr Compliance-Management-System (CMS) zertifizieren lassen k\u00f6nnen. Unterwerfen sich Unternehmen der sogenannten ON-Regel \u2013 die in etwa mit der deutschen DIN vergleichbar ist -, k\u00f6nnen sie so demonstrieren, dass ihr CMS festgelegten Standards folgt. Und wenn es dennoch zu einem Compliance-Versto\u00df im Unternehmen kommt, kann mit Hilfe der Zertifizierung der Verschuldensvorwurf entkr\u00e4ftet werden. Auch f\u00fcr deutsche Unternehmen bietet die \u00f6sterreichische Norm eine gute Orientierungshilfe: sie beschreibt, wie sich ein Unternehmen organisieren sollte, um ein Risiko erkennen, verstehen und in weiterer Folge richtig behandeln zu k\u00f6nnen.
