{"id":894,"date":"2024-07-17T17:56:02","date_gmt":"2024-07-17T17:56:02","guid":{"rendered":"https:\/\/www.avvocato-reichel.com\/?p=894"},"modified":"2025-06-23T08:28:12","modified_gmt":"2025-06-23T08:28:12","slug":"erbfaelle-mit-auslandsbezug-internationaler-erbschein-kommt","status":"publish","type":"post","link":"https:\/\/www.avvocato-reichel.com\/en\/erbfaelle-mit-auslandsbezug-internationaler-erbschein-kommt\/","title":{"rendered":"Erbf\u00e4lle mit Auslandsbezug: Internationaler Erbschein kommt!"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\"><strong>Das Europ\u00e4ische Parlament f\u00fcr grenz\u00fcberschreitende Erbf\u00e4lle die neue \u201cEurop\u00e4ische Erbrechtsverordnung\u201d (EU-ErbVO, Verordnung des Europ\u00e4ischen Parlaments und des Rates \u00fcber die Zust\u00e4ndigkeit, das anzuwendende Recht, die Anerkennung und die Vollstreckung von Entscheidungen und \u00f6ffentlichen Urkunden in Erbsachen sowie zur Einf\u00fchrung eines europ\u00e4ischen Nachlasszeugnisses) erlassen.<\/strong><\/h2>\n\n\n\n<p><strong>Ein Kernst\u00fcck der EU-ErbVO ist die Einf\u00fchrung eines europ\u00e4ischen Erbscheins (\u201ceurop\u00e4isches Nachlasszeugnis\u201d), der die Abwicklung&nbsp;<\/strong>von grenz\u00fcberschreitenden Erbf\u00e4llen innerhalb der EU erleichtern soll. Erben m\u00fcssen sich k\u00fcnftig also nicht mehr in jedem Land ein eigenes Nachlasszeugnis ausstellen lassen. Der europ\u00e4ische Erbschein \u00e4hnelt in Inhalt und Wirkung dem deutschen Erbschein: er gibt z.B. Auskunft \u00fcber das anwendbare Recht, die Person des Erben, die Erbquoten und die Verm\u00f6genswerte. Ebenso wie der deutsche enth\u00e4lt der europ\u00e4ische Erbschein eine Vermutungswirkung dahingehend, das die im Erbschein benannte Person zur Rechtsnachfolge berechtigt bzw. mit den im Erbschein ausgewiesenen Befugnissen ausgestattet ist und keine anderen Verf\u00fcgungsbeschr\u00e4nkungen als die ausgewiesenen bestehen. Er dient als Nachweis f\u00fcr die Stellung als Erbe, Nachlassverwalter oder Testamentsvollstrecker.<\/p>\n\n\n\n<p><strong>Neben der Einf\u00fchrung des internationalen Erbschein soll durch die Regelungen der EU-ErbVO aber auch europaweit (ausgenommen:<\/strong>&nbsp;Gro\u00dfbritannien, Irland, D\u00e4nemark) Einklang herrschen \u00fcber Zust\u00e4ndigkeiten und anwendbares Erbrecht bei Erbschaften mit Auslandsbezug. Die Regelungen sollen zu einer einheitlichen Beantwortung der Frage f\u00fchren, ob z.B. f\u00fcr einen in Italien lebenden Deutschen bei Eintritt des Erbfalles das deutsche oder das italienische Recht anzuwenden ist. Das materielle Erbrecht, also das Erbschaft- und Schenkungssteuerrecht sowie das G\u00fcterrecht, werden von der EU-ErbVO allerdings nicht betroffen, eine EU- weite Harmonisierung des Erbrechts findet durch die neue EU-ErbVO daher nicht statt!<\/p>\n\n\n\n<p>Ausweislich der Regelungen in der EU-ErbVO soll zur Beantwortung der Frage, welches materielle Recht zur Anwendung kommt, i.d.R. k\u00fcnftig an den letzten gew\u00f6hnlichen Aufenthalt des Erblassers angekn\u00fcpft werden. Allerdings wird dem Erblasser zus\u00e4tzlich auch die M\u00f6glichkeit gegeben, das Recht seiner EU- &nbsp;Staatsangeh\u00f6rigkeit zu w\u00e4hlen. So w\u00fcrde der in Italien lebende Deutsche also grunds\u00e4tzlich nach italienischem Recht vererben, k\u00f6nnte sich aber auch f\u00fcr das deutsche Erbrecht entscheiden.<\/p>\n\n\n\n<p>Bei Tod in einem EU-Mitgliedsstaat, dessen Staatsangeh\u00f6rigkeit der Erblasser nicht innehat, soll nach den Regelungen in der EU-ErbVO die Erbschaft nach den Regelungen und von den Gerichten des Mitgliedsstaates abgewickelt werden, in dem der Erblasser zuletzt seinen ordentlichen Wohnsitz hatte. Somit soll vermieden werden, dass sich Gerichte in verschiedenen Mitgliedsstaaten f\u00fcr zust\u00e4ndig erkl\u00e4ren und unterschiedliche Regeln zur Anwendung bringen wollen.<\/p>\n\n\n\n<p>Alternativ hat der Erblasser die M\u00f6glichkeit, seine testamentarischen Verf\u00fcgungen nach den Regeln des EU- Mitgliedstaates, dessen Staatsangeh\u00f6rigkeit er inne hat,&nbsp; abwickeln zu lassen. Damit kann er sicherzustellen, dass die in seinem Heimatland vorgesehenen Bestimmungen zum Tragen kommen, z.B. im Fall von Schenkungen, die er zu Lebzeiten vornimmt.<\/p>\n\n\n\n<p>Die formale Zustimmung des Ministerrates, die f\u00fcr das Inkrafttreten der Erbrechtsverordnung notwendig ist, steht augenblicklich noch aus, nach derzeitigem Kenntnisstand ist mit ihr aber etwa Mitte diesen Jahres zu rechnen. Gelten soll die Erbrechtsverordnung dann f\u00fcr Erbf\u00e4lle ab ca.
