{"id":902,"date":"2024-07-18T13:34:45","date_gmt":"2024-07-18T13:34:45","guid":{"rendered":"https:\/\/www.avvocato-reichel.com\/?p=902"},"modified":"2024-07-18T13:38:05","modified_gmt":"2024-07-18T13:38:05","slug":"zollfalle-pkw-kontrolle","status":"publish","type":"post","link":"https:\/\/www.avvocato-reichel.com\/en\/zollfalle-pkw-kontrolle\/","title":{"rendered":"Zollfalle PKW- Kontrolle !"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\"><strong>Es ist einer der Dauerbrenner bei den im Zusammenhang mit zollrechtlichen Fragen in der Kanzlei Reichel eingehenden Anfragen: darf der Zoll bei der nur vor\u00fcbergehenden Verwendung eines nicht in der EU zugelassenen Kraftfahrzeuges tats\u00e4chlich Geb\u00fchren und Steuer verlangen?<\/strong><\/h2>\n\n\n\n<p>Es ist einer der&nbsp;<em>Dauerbrenner<\/em>&nbsp;bei den im Zusammenhang mit zollrechtlichen Fragen in der Kanzlei Reichel eingehenden Anfragen: darf der Zoll bei der nur vor\u00fcbergehenden Verwendung eines nicht in der EU zugelassenen Kraftfahrzeuges tats\u00e4chlich Geb\u00fchren und Steuer verlangen?<\/p>\n\n\n\n<p>Was sich hinter der Fragestellung verbirgt, zeigt der nachfolgende&nbsp;<em>Beispielsfall<\/em>: Ein deutsches Ehepaar ist zu Besuch bei Freunden in der Schweiz. Die Schweizer leihen den Deutschen ihr neues Porsche-Cabriolet mit Schweizer Kennzeichen f\u00fcr eine Tour nach \u00d6sterreich. Schon bei der Einreise nach \u00d6sterreich kommt das deutsche Ehepaar in eine Zollkontrolle&nbsp;<em>mit ungeahnten Folgen<\/em>. Der&nbsp;Zoll verlangt nicht nur&nbsp;<em>Zollgeb\u00fchren<\/em>, sondern auch die&nbsp;<em>Einfuhrumsatzsteuer<\/em>&nbsp;in H\u00f6he von 21 %, errechnet nach dem Verkehrswert des PKW zzgl. den entstandenen Zollgeb\u00fchren. Doch damit nicht genug: hinzu kommt auch noch eine&nbsp;<em>saftige Strafe wegen Zollvergehens<\/em>. Die \u00f6sterreichischen Zollbeamten verlangen von dem deutschen Ehepaar eine Kaution von mehreren tausend Euro, zahlbar sofort. Da das Ehepaar den Betrag nicht aufbringen kann, wird der PKW beschlagnahmt.<\/p>\n\n\n\n<p>Den Deutschen wird nun erkl\u00e4rt, dass sie als EU-B\u00fcrger den im Nicht-EU-Land Schweiz zugelassenen PKW nicht in das Zollgebiet der EU-Gemeinschaft h\u00e4tten bringen d\u00fcrfen, ohne daf\u00fcr Zoll und Einfuhrumsatzsteuer zu entrichten. Das Ehepaar fragt jetzt in der Kanzlei nach, ob die Erhebung von Geb\u00fchren und Steuer wirklich zu Recht erfolgte.<\/p>\n\n\n\n<p>Die Antwort lautet: ja, die Erhebung von Zoll und Einfuhrumsatzsteuer erfolgte im Beispielsfall tats\u00e4chlich zu Recht.&nbsp;<strong><em>EU-B\u00fcrger d\u00fcrfen ein im Nicht-EU-Mitgliedstaat zugelassenes Fahrzeug zum eigenen Gebrauch nur im Ausnahmefall in das Zollgebiet der EU einf\u00fchren und vor\u00fcbergehend verwenden unter folgenden Voraussetzungen<\/em><\/strong>:<\/p>\n\n\n\n<p>\u2013&nbsp;&nbsp;&nbsp; das Fahrzeug wird&nbsp;<em>gelegentlich nach Weisung<\/em>&nbsp;des Zulassungsinhabers genutzt, wobei sich aber der Zulassungsinhaber w\u00e4hrend der Benutzung in der EU aufhalten muss. Tipp: In diesem Fall kann das Bereithalten einer entsprechenden Vollmacht des Zulassungsinhabers zur Vorlage bei einer Zollkontrolle empfehlenswert sein!<\/p>\n\n\n\n<p>\u2013&nbsp;&nbsp;&nbsp; es liegt eine&nbsp;<em>Notsituation<\/em>&nbsp;vor. Die R\u00fcckkehr aus dem Nicht-EU-Mitgliedstaat ist nur mit dem ausl\u00e4ndischen Fahrzeug m\u00f6glich, weil das eigene Fahrzeug im Ausland ausgefallen ist. Das im Nicht-EU-Mitgliedstaat zugelassenen Fahrzeug muss in diesem Fall aber innert f\u00fcnf Tagen wieder ausgef\u00fchrt werden.<\/p>\n\n\n\n<p>\u2013&nbsp;&nbsp;&nbsp; die Wiedereinreise erfolgt&nbsp; mit einem im Nicht-EU-Mitgliedstaat zugelassenen&nbsp;<em>Mietfahrzeug von Vermietungsunternehmen<\/em>.
