{"id":403,"date":"2024-07-17T17:46:52","date_gmt":"2024-07-17T17:46:52","guid":{"rendered":"https:\/\/www.avvocato-reichel.com\/?p=403"},"modified":"2024-07-17T17:46:53","modified_gmt":"2024-07-17T17:46:53","slug":"europarecht-aktuell-verletzung-des-persoenlichkeitsrechts-im-internet","status":"publish","type":"post","link":"https:\/\/www.avvocato-reichel.com\/it\/europarecht-aktuell-verletzung-des-persoenlichkeitsrechts-im-internet\/","title":{"rendered":"Europarecht aktuell: Verletzung des Pers\u00f6nlich-keitsrechts im Internet"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\"><strong>Der Europ\u00e4ische Gerichtshof (EuGH) hat zur gerichtlichen Zust\u00e4ndigkeit f\u00fcr Klagen juristischer Personen wegen Pers\u00f6nlichkeitsrechtsverletzungen im Internet entschieden (EuGH, Urteil vom&nbsp;17.10.2017,&nbsp;Az.: C 194\/16). Zuvor hatte er bereits f\u00fcr nat\u00fcrliche Personen dahingehend entschieden, dass die Person, deren Pers\u00f6nlichkeitsrechte verletzt sind durch Inhalte, die auf einer Website ver\u00f6ffentlicht worden sind, die M\u00f6glichkeit hat, bei den Gerichten des Mitgliedstaates, in dem sich der Mittelpunkt ihrer Interessen befindet, eine Klage auf Ersatz des gesamten entstandenen Schadens zu erheben (EuGH, Urteil vom&nbsp;25.10.2011,&nbsp;Azn.: C-509\/09 und C 161\/10).<\/strong><\/h2>\n\n\n\n<p>In dem vom EuGH zuletzt entschiedenen Fall machte die Kl\u00e4gerin als Unternehmen geltend, die Beklagte habe sie in eine auf ihrer Website gef\u00fchrte sog. \u201eschwarze Liste\u201c mit dem Eintrag aufgenommen, sie betreibe \u201eBetrug und Gaunerei\u201c. Im Diskussionsforum der Website f\u00e4nden sich nahezu 1.000 Kommentare, darunter auch direkte Aufrufe zur Gewalt. Die Beklagte habe sich geweigert, den Eintrag und die Kommentare zu entfernen. Dadurch sei die wirtschaftliche T\u00e4tigkeit der Kl\u00e4gerin in einem anderen EU-Staat lahmgelegt, so dass ihr t\u00e4glich materieller Schaden entstehe.<\/p>\n\n\n\n<p>Fraglich war, in welchem Land die Klage auf Schadensersatz, Richtigstellung und Entfernung der Kommentare gegen die Beklagte erhoben werden kann.<\/p>\n\n\n\n<p>Der EuGH hat entschieden, dass im Fall einer unerlaubten Handlung die Beklagte nicht nur in dem Mitgliedstaat verklagt werden k\u00f6nne, in dem sie ihren Wohnsitz\/Gesellschaftssitz hat, sondern auch vor den Gerichten des Mitgliedstaates, in dem sich das urs\u00e4chliche Geschehen ereignet hat oder in dem sich der Schadenserfolg verwirklicht hat.<\/p>\n\n\n\n<p>W\u00fcrde, wie im vorliegenden Fall, die betreffende juristische Person den gr\u00f6\u00dften Teil ihrer T\u00e4tigkeit in einem anderen Mitgliedstaat als dem ihres satzungsm\u00e4\u00dfigen Sitzes aus\u00fcben, so k\u00f6nne sie den mutma\u00dflichen Urheber der Verletzung unter Ankn\u00fcpfung an den Ort der Verwirklichung des Schadenserfolges in diesem anderen Mitgliedstaat verklagen.<\/p>\n\n\n\n<p>In Anbetracht der umfassenden Abrufbarkeit der auf einer Website ver\u00f6ffentlichten Angaben und Inhalte sowie des Umstandes, dass die Reichweite ihrer Verbreitung grunds\u00e4tzlich weltumspannend sei, sei ein auf die Richtigstellung dieser Angaben und die Entfernung dieser Inhalte gerichteter Antrag einheitlich und untrennbar und k\u00f6nne somit nur bei dem Gericht erhoben werden, das f\u00fcr die Entscheidung \u00fcber einen Antrag auf Ersatz des gesamten Schadens zust\u00e4ndig sei.<\/p>\n\n\n\n<p><strong><em>RA\u2018in Beatrix Gro\u00dfblotekamp LL.M &#8211; Studio Legale Reichel<\/em><\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Der Europ\u00e4ische Gerichtshof (EuGH) hat zur gerichtlichen Zust\u00e4ndigkeit f\u00fcr Klagen juristischer Personen wegen Pers\u00f6nlichkeitsrechtsverletzungen im Internet entschieden (EuGH, Urteil vom 17.10.2017, Az.: C 194\/16).<\/p>\n","protected":false},"author":3,"featured_media":2068,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[32],"tags":[],"class_list":["post-403","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-europarecht","entry","has-media"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.4 -
