Was ist dabei zu beachten? Der nachfolgende Artikel bietet einen ersten \u00dcberblick.<\/strong><\/h2>\n\n\n\n<p>Die Immobilie kann auf die Erben umgeschrieben werden, wenn<\/p>\n\n\n\n<p>\u2013 die Erbfolge belegt werden kann,<\/p>\n\n\n\n<p>\u2013 ein entsprechender Katasterumschreibungsantrag gestellt wurde und<\/p>\n\n\n\n<p>\u2013 der Nachweis \u00fcber die Zahlung von eventuell angefallenen Steuern erfolgt ist. Zu den Steuern geh\u00f6ren grunds\u00e4tzlich die Erbschaftssteuern und die Steuern f\u00fcr die Umschreibung der Immobilie, und zwar die Hypothekar- (2 %) und die Katastersteuer (1 %).<\/p>\n\n\n\n<p>Bevor die Erben allerdings Antr\u00e4ge stellen und Erkl\u00e4rungen einreichen k\u00f6nnen, ist zwingend zun\u00e4chst die italienische Steuernummer, der sog<em>. codice fiscale<\/em>, zu beantragen.<\/p>\n\n\n\n<p>Die Umschreibung der Immobilie in Italien ist f\u00fcr Erben aus dem Ausland leicht aufwendiger als die Abwicklung einer Erbschaft \u201evor Ort\u201c in Deutschland oder der Schweiz, aber allein darin ist kein Grund zu sehen, vom Erwerb eine Immobilie in Italien Abstand zu nehmen oder diese gar im Alter zu ver\u00e4u\u00dfern. Dies zumal, als mit der Abwicklung und Umschreibung beispielsweise auch ein deutschsprachiger Rechtsanwalt in Italien beauftragt werden kann, der alles Erforderliche f\u00fcr die Erben in die Wege leitet.<\/p>\n\n\n\n<p>Auch Bedenken wegen des m\u00f6glichen Anfalls von italienischer Erbschaftssteuer m\u00fcssen nicht abschrecken. Die italienische Erbschaftssteuer ist aufgrund der derzeit hohen Freibetr\u00e4ge von 1 Millionen Euro f\u00fcr Ehegatten, Kinder und Enkel durchaus als g\u00fcnstig zu bezeichnen. Den Erben kommt bei der Wertermittlung zus\u00e4tzlich auch entgegen, dass der deutlich niedrige Katasterwert (und nicht der tats\u00e4chliche Marktwert) der Immobilie als Bemessungsgrundlage f\u00fcr die Berechnung der Erbschaftssteuer herangezogen wird. Zu bedenken ist, dass grunds\u00e4tzlich auch deutsche Erbschaftssteuer anf\u00e4llt; gegebenenfalls kommt aber die Anrechnung der italienischen auf die deutsche Erbschaftssteuer in Betracht.<\/p>\n\n\n\n<p>Erblasser, die ihren k\u00fcnftigen Erben noch zu Lebzeiten die Abwicklung im Erbfall erleichtern m\u00f6chten, k\u00f6nnen z.B. daran denken, ihre Ferienimmobilie schon zu Lebzeiten an die k\u00fcnftigen Erben zu verschenken und sich daran einfach das eigene lebenslange Nie\u00dfbrauchsrecht vorzubehalten.
