{"id":704,"date":"2024-07-18T07:35:45","date_gmt":"2024-07-18T07:35:45","guid":{"rendered":"https:\/\/www.avvocato-reichel.com\/?p=704"},"modified":"2024-07-18T07:35:47","modified_gmt":"2024-07-18T07:35:47","slug":"vorsorgerecht-aktuell-patientenverfuegung-muss-konkret-sein","status":"publish","type":"post","link":"https:\/\/www.avvocato-reichel.com\/it\/vorsorgerecht-aktuell-patientenverfuegung-muss-konkret-sein\/","title":{"rendered":"Vorsorgerecht aktuell: Patientenverf\u00fcgung muss konkret sein!"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\"><strong>Der Bundesgerichtshof (BGH) hat sich in einer aktuellen Entscheidung mit den Anforderungen befasst, die eine Vorsorgevollmacht und eine Patientenverf\u00fcgung im Zusammenhang mit dem Abbruch von lebenserhaltenden Ma\u00dfnahmen erf\u00fcllen m\u00fcssen. Nach der Entscheidung des Gerichts (Az.: XII ZB 61\/16) muss die Patientenverf\u00fcgung m\u00f6glichst konkret sein. Ungenaue Aussagen \u2013 wie z.B. \u201eIch w\u00fcnsche keine lebenserhaltenden Ma\u00dfnahmen\u201c \u2013 sind nicht mehr ausreichend.<\/strong><\/h2>\n\n\n\n<p>Anlass der Entscheidung war der gerichtlich ausgetragene Streit zwischen drei T\u00f6chtern \u00fcber den richtigen Umgang mit der pflegebed\u00fcrftigen Mutter. Die Mutter hatte in ihrer Patientenverf\u00fcgung festgehalten, dass im Falle eines schweren Dauerschadens des Gehirns infolge von Krankheit oder Unfall \u201e<em>lebensverl\u00e4ngernde Ma\u00dfnahmen unterbleiben<\/em>&nbsp;<em>sollen<\/em>\u201c. In der Folgezeit hatte sie einen Hirnschlag erlitten und wird seitdem \u00fcber eine Magensonde ern\u00e4hrt. Eine ihrer T\u00f6chter vertritt \u2013 anders als die beiden anderen T\u00f6chter \u2013 die Ansicht, dass eine Beendung der k\u00fcnstlichen Ern\u00e4hrung nicht dem Willen der Mutter entspricht und hat sich daher daf\u00fcr eingesetzt, dass die k\u00fcnstliche Ern\u00e4hrung fortgesetzt wird.<\/p>\n\n\n\n<p>Der BGH hat festgestellt, dass die \u00c4u\u00dferung, \u201ekeine lebenserhaltenden Ma\u00dfnahmen\u201c zu w\u00fcnschen, f\u00fcr sich genommen keine hinreichend konkrete Behandlungsentscheidung enth\u00e4lt. Der \u00c4u\u00dferung sei keine bindende, auf den Abbruch der k\u00fcnstlichen Ern\u00e4hrung gerichtete Handlungsanweisung zu entnehmen. Eine wirksame Handlungsanweisung erfordere eine Konkretisierung, wie z.B. die Benennung bestimmter \u00e4rztlicher Ma\u00dfnahmen oder Behandlungssituationen.<\/p>\n\n\n\n<p><strong>Fazit:<\/strong>&nbsp;Aussagen, wie z.B. \u201eIch w\u00fcnsche keine lebenserhaltenden Ma\u00dfnahmen\u201c, sind f\u00fcr eine bindende Handlungsanweisung nicht mehr ausreichend. Die Festlegungen in Patientenverf\u00fcgungen sind ab jetzt nur bindend, wenn einzelne \u00e4rztliche Ma\u00dfnahmen genannt oder Krankheiten und Behandlungssituationen klar beschrieben werden.
