{"id":752,"date":"2024-07-18T09:34:04","date_gmt":"2024-07-18T09:34:04","guid":{"rendered":"https:\/\/www.avvocato-reichel.com\/?p=752"},"modified":"2024-07-18T09:34:05","modified_gmt":"2024-07-18T09:34:05","slug":"umsetzung-der-eu-mobilitaets-richtlinie","status":"publish","type":"post","link":"https:\/\/www.avvocato-reichel.com\/it\/umsetzung-der-eu-mobilitaets-richtlinie\/","title":{"rendered":"Umsetzung der EU-Mobilit\u00e4ts-Richtlinie"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">EU-Mobilit\u00e4tsrichtlinie. <strong>Zur Verbesserung der EU-weiten Arbeitnehmerfreiz\u00fcgigkeit hat das deutsche Bundeskabinett den Entwurf des Gesetzes zur Umsetzung der sog. EU-Mobilit\u00e4ts-Richtlinie beschlossen. Die Richtlinie 2014\/50\/EU des Europ\u00e4ischen Parlaments und des Rates vom 16. April 2014 \u00fcber Mindestvorschriften zur Erh\u00f6hung der Mobilit\u00e4t von Arbeitnehmern zwischen den Mitgliedstaaten durch Verbesserung des Erwerbs und der Wahrung von Zusatzrentenanspr\u00fcchen soll Mobilit\u00e4tshindernisse abbauen, die sich aus Regelungen zur betrieblichen Altersversorgung ergeben k\u00f6nnen.<\/strong><\/h2>\n\n\n\n<p>Das Gesetz sieht folgende Schwerpunkte vor:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Arbeitgeberfinanzierte Betriebsrentenanwartschaften bleiben k\u00fcnftig bereits dann erhalten, wenn die Zusage drei Jahre bestanden hat; bislang war die Frist f\u00fcnf Jahre. Dar\u00fcber hinaus wird das Lebensalter, zu dem dabei fr\u00fchestens der Arbeitgeber verlassen werden darf, ohne dass die Anwartschaft verf\u00e4llt, vom 25. auf das 21. Lebensjahr abgesenkt.<\/li>\n\n\n\n<li>Betriebsrentenanwartschaften ausgeschiedener und beim Arbeitgeber verbliebener Besch\u00e4ftigter m\u00fcssen gleich behandelt werden.<\/li>\n\n\n\n<li>Die Abfindungs- und Auskunftsrechte werden zugunsten der Besch\u00e4ftigten erweitert.<\/li>\n<\/ul>\n\n\n\n<p>Die neuen Regelungen sollen am 01.01.2018 in Kraft treten und f\u00fcr alle Besch\u00e4ftigten gelten. Besch\u00e4ftigte m\u00fcssen dann nicht mehr bef\u00fcrchten, dass ein EU- weiter Arbeitgeberwechsel ihrer Betriebsrente schadet: die verk\u00fcrzte Unverfallbarkeitsfrist wird in der Praxis dazu f\u00fchren, dass k\u00fcnftig mehr arbeitgeberfinanzierte Betriebsrentenanwartschaften f\u00fcr ausgeschiedene Arbeitnehmer erhalten bleiben. Zudem k\u00f6nnen junge Besch\u00e4ftigte k\u00fcnftig schneller und fr\u00fcher als bisher unverfallbare Betriebsrentenanwartschaften erwerben.
