Dieser Prozess hat sich in den letzten 15 Jahren langsam entwickelt und es ist abzusehen, dass in Europa immer mehr Anlagen zur alternativen Energiegewinnung entstehen werden. Woraus die Energie gewonnen wird, ist nat\u00fcrlich abh\u00e4ngig von den klimatischen Verh\u00e4ltnissen der einzelnen L\u00e4nder. In Italien ist dies die Sonne. Deshalb sind hier in den letzten Jahren immer mehr Anlagen zur Gewinnung von Sonnenenergie, so genannte Photovoltaik-Anlagen, entstanden. Dieser Trend wird sich auch in Zukunft fortsetzen.<\/strong><\/h2>\n\n\n\n

Diese Anlagen stellen auch ein durchaus lohnenswertes Investment dar. Im Folgenden soll die diesem Investment zugrunde liegende rechtliche Situation aufgezeigt werden, die es nat\u00fcrlich bei der Entscheidung \u00fcber ein \u201eob\u201c und \u201ewie\u201c der Investition zu beachten gilt.<\/p>\n\n\n\n

Die Entwicklung der gesetzlichen Regelungen in Italien<\/strong><\/h2>\n\n\n\n

Der erste Schritt der Europ\u00e4ischen Union hin zu der gr\u00f6\u00dferen Nutzung erneuerbarer Energien geht auf den 20. November 1996 zur\u00fcck, als die Europ\u00e4ische Kommission das Gr\u00fcnbuch \u201eEnergie f\u00fcr die Zukunft: Erneuerbare Energiequellen\u201c herausgegeben hat, in dem Ma\u00dfnahmen diskutiert werden, die sowohl auf Gemeinschafts- als auch auf nationaler Ebene die F\u00f6rderung von Energie aus alternativen Quellen und die Verringerung der \u00d6limporte aus OPEC-produzierenden L\u00e4ndern zum Thema hatten. Im Jahr 1997 folgte die Herausgabe des Wei\u00dfbuchs \u00fcber eine Strategie und einen Aktionsplan der Gemeinschaft, w\u00e4hrend im Jahr 2001 sich das Gr\u00fcnbuch \u00fcber die Sicherheit der Energieversorgung auch mit der Frage der Energieabh\u00e4ngigkeit der Mitgliedsl\u00e4nder besch\u00e4ftigte.
In Italien wurde per Gesetzesdekret aus dem Jahre 2003 einerseits das Verwaltungsverfahren f\u00fcr die Realisierung der Anlagen vereinfacht und andererseits ein Anreizsystem zur Verbreitung der Stromerzeugung aus erneuerbaren Energiequellen geschaffen<\/p>\n\n\n\n

Das Verwaltungsverfahren<\/strong>.<\/h2>\n\n\n\n

Die Genehmigung von Photovoltaik \u2013 Anlagen erfolgt durch die zust\u00e4ndigen staatlichen Stellen unter Ber\u00fccksichtigung der Belange des Landschafts- und Kulturschutzes.<\/p>\n\n\n\n

Sie ist einheitlich und erfasst auch die Bau- und Betriebserlaubnis f\u00fcr die Anlage. Weiterhin sind schon in dieser Genehmigung etwaige Auflagen in Bezug auf den Umweltschutz enthalten. Sie wird, so gesetzlich vorgesehen, innerhalb von sp\u00e4testens 180 Tagen nach Antrag erteilt.<\/p>\n\n\n\n

Finanzielle Gesichtspunkte<\/strong><\/h2>\n\n\n\n

Die finanzielle F\u00f6rderung von Sonnenenergie ist in einem Erlass des Ministeriums f\u00fcr Wirtschaftsentwicklung aus dem Jahr 2007 geregelt. Diesem Erlass bestimmt Kriterien und Methoden zur F\u00f6rderung der Erzeugung von Elektrizit\u00e4t durch die photovoltaische Umwandlung von Sonnenenergie.<\/p>\n\n\n\n

Hierin enthalten ist, f\u00fcr Investoren besonders interessant, ein Preisanreiz f\u00fcr einen Zeitraum von zwanzig Jahren ab Betriebsbeginn der Anlage. Gerade durch diesen garantierten R\u00fcckfluss get\u00e4tigter Investments \u00fcber den Zeitraum von 20 Jahren wurde die Entwicklung der Sonnenenergie in Italien stark angekurbelt.<\/p>\n\n\n\n

In nachfolgenden Dekreten wurden sodann die einzelnen Bedingungen und die jeweilige H\u00f6he des finanziellen Anreizes im Einzelnen definiert.<\/p>\n\n\n\n

Wie in die Sonnenenergie investieren?<\/strong><\/h2>\n\n\n\n

Dem Einstieg in ein solches Investment muss zun\u00e4chst die Entscheidung zugrunde gelegt werden, ob man eine Photovoltaik-Anlage als Immobilie oder aber als bewegliche Sache erwirbt. Beides ist nach italienischem Recht \u2013 abh\u00e4ngig vom Bau der Anlage \u2013 m\u00f6glich. Durch eine feste Verbindung mit dem Boden geht n\u00e4mlich eine solche Anlage in das Eigentum des Grundeigent\u00fcmers \u00fcber.<\/p>\n\n\n\n
